FamilySpend — Terms of Service

1. Acceptance

By downloading, installing, or using FamilySpend (the "App"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the App.

If you're using the App on behalf of others (e.g., setting it up for your household), you confirm you have authority to bind them too — for example, that adult household members agree to these Terms as you invite them.

2. Who we are

The App is offered by Viacheslav Volosheniuk, an individual based in Alberta, Canada, doing business as Hesti. In these Terms, "we", "our", and "us" refer to Viacheslav Volosheniuk.

If FamilySpend is later transferred to a registered business entity, we will notify you per Section 16 (Changes to these Terms).

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use. This license is subject to your compliance with these Terms.

What this license does NOT permit:

6.1 Freemium model

FamilySpend uses a freemium model. The core App is free to install and use for tracking your own spending. Advanced family features (shared spaces, shopping lists, monthly reports, higher limits) require the FamilySpend Premium subscription described in §6.2. Billing is handled exclusively through Apple In-App Purchase. We never see, store, or process your payment card information.

7. Your content and data

7.1 Ownership

You own the content you create in the App — your transactions, shopping list items, budgets, goals, and other data you input. We don't claim ownership of your data.

7.2 License to us

To provide the service, you grant us a limited, non-exclusive, royalty-free license to host, store, transmit, display, and process your content only as necessary to deliver the App's functionality (e.g., showing your transactions to other members of your household). We do not use your content for any other purpose — not marketing, not AI training, not analytics.

7.3 Responsibility for your content

You are responsible for the accuracy and legality of the content you enter. We rely on you to enter correct numbers; we cannot verify your spending or financial situation independently.

8. Households ("spaces") and shared data

A "space" is a household in FamilySpend — a group of users who share financial data (transactions, lists, budgets).

8.1 Inviting others

When you invite a member to a space you own, you authorize them to view and contribute to that space's data. Once they accept, they have the access permitted by their role (owner or member).

8.2 What members see

All members of a space see all data within that space — that's the core value of FamilySpend. By joining a space, you accept this visibility.

8.3 Leaving or being removed

If you're the sole owner of a space and want to leave or delete your account, you must first either (a) transfer ownership to another member, or (b) delete the entire space (which requires all members' consent).

If the App becomes unavailable, we'll do our reasonable best to provide a data export path so you don't lose your information.

You can stop using the App and delete your account at any time. Email privacy@hesti.app — deletion proceeds per the Privacy Policy.

We can suspend or terminate your account if:

For non-emergency terminations, we'll notify you and, where possible, give you a chance to fix the issue first.

11.3 Effect of termination

On termination, your account access ends. Data deletion proceeds per the Privacy Policy. Sections 7.1, 7.2, 12, 13, 14, 15, and 16 survive termination.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We are not a financial advisor, accountant, or tax professional. The App is a tool for tracking and visualizing your data. You are solely responsible for your financial decisions. Do not rely on the App as the sole source of truth for legally or financially significant matters (e.g., taxes, investments, debt management). Always consult a qualified professional for those.

Some jurisdictions don't allow disclaiming certain warranties; in those, the disclaimers apply to the maximum extent permitted by law.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Some jurisdictions (e.g., parts of the EU and UK) impose additional non-excludable consumer rights. Where those apply, our liability to consumers in those jurisdictions is governed by local consumer protection law.

To the extent permitted by law, you agree to indemnify and hold harmless Viacheslav Volosheniuk from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

15. Governing law and dispute resolution

15.1 Governing law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15.2 Informal dispute resolution

If you have a dispute with us, please email legal@hesti.app first. We'll respond within 30 days and try to resolve it informally. Most issues can be solved this way without litigation.

15.3 Court jurisdiction

If informal resolution fails, disputes shall be brought exclusively in the courts of the Province of Alberta, Canada (specifically, courts located in Calgary or Edmonton). You consent to the personal jurisdiction of those courts.

EU/UK consumer-protection laws may grant you the right to bring proceedings in your local courts; these Terms don't override those rights.

15.4 No class actions

To the extent permitted by law, you agree that disputes will be resolved on an individual basis, not as a class, consolidated, or representative action. (Some jurisdictions don't allow class action waivers; in those, this clause doesn't apply.)

16. Changes to these Terms

We may update these Terms. Material changes will be announced via:
