FamilySpend — Terms of Service
1. Acceptance
By downloading, installing, or using FamilySpend (the "App"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the App.
If you're using the App on behalf of others (e.g., setting it up for your household), you confirm you have authority to bind them too — for example, that adult household members agree to these Terms as you invite them.
2. Who we are
The App is offered by Viacheslav Volosheniuk, an individual based in Alberta, Canada, doing business as Hesti. In these Terms, "we", "our", and "us" refer to Viacheslav Volosheniuk.
If FamilySpend is later transferred to a registered business entity, we will notify you per Section 16 (Changes to these Terms).

3. The short version
- You can use FamilySpend for personal/household financial coordination. Free to install; advanced family features require a paid subscription (FamilySpend Premium, handled via Apple In-App Purchase; we never see your card details).
- We don't guarantee uptime, perfect data accuracy, or financial advice — you're responsible for your own money decisions.
- We can terminate accounts that abuse the service.
- You can delete your account anytime; data goes per our Privacy Policy.
- Our liability is capped at what you've paid us in the past 12 months — for free users that's $0; for subscribers it's whatever they've paid in subscription fees during that period.
- Disputes are governed by Alberta law and Alberta courts.
- This is a Canadian indie product. We'll be reasonable; we expect you to be too.
4. Eligibility
To use FamilySpend, you must:
- Be at least 13 years old (per Apple's App Store guidelines and our Privacy Policy).
- To be the owner of a household ("space") with multiple members, you must be at least 18 years old (or the age of majority in your jurisdiction).
- Have authority to enter these Terms in your jurisdiction.
- Not be barred from using the App by applicable law (e.g., trade sanctions).
If you're under 18 (but at least 13), you should have a parent or guardian's involvement in your use of the App.
5. Your account
- You're responsible for keeping your password and account credentials confidential.
- You're responsible for activity that happens under your account, except where due to a security failure on our side.
- One person per account. Don't share accounts. (Households are different — multiple people can be in the same household via the invite flow.)
- If you suspect unauthorized access, notify us immediately at legal@hesti.app.
6. License to use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your personal, non-commercial use. This license is subject to your compliance with these Terms.
What this license does NOT permit:
- Sublicensing, renting, leasing, or selling the App
- Reverse engineering, decompiling, or attempting to extract source code (except as permitted by applicable law)
- Using the App to build a competing service
- Removing or altering any proprietary notices
- Using the App in ways that violate applicable law
6.1 Freemium model
FamilySpend uses a freemium model. The core App is free to install and use for tracking your own spending. Advanced family features (shared spaces, shopping lists, monthly reports, higher limits) require the FamilySpend Premium subscription described in §6.2. Billing is handled exclusively through Apple In-App Purchase. We never see, store, or process your payment card information.
6.2 FamilySpend Premium subscription
- Plans and price. FamilySpend Premium is offered as a monthly or an annual auto-renewing subscription. The current price and billing period are always shown in the app before you purchase, in your local currency as set by Apple.
- Free trial. The monthly plan may include a one-month free trial for eligible Apple IDs. Apple determines eligibility; one trial per Apple ID per subscription group. If you do not cancel at least 24 hours before the trial ends, the subscription renews automatically at the then-current price.
- Auto-renewal and cancellation. Subscriptions renew automatically until cancelled. Cancel in Settings → your Apple ID → Subscriptions, at least 24 hours before the renewal date. Deleting the app does not cancel a subscription.
- Plan changes. Switching between monthly and annual takes effect at the end of your current billing period. There is no proration.
- Refunds. All billing is handled by Apple. Refund requests go to Apple; we cannot issue refunds directly.
- What happens when a subscription ends. We never delete your data. When Premium ends: (a) items above the free-tier limits become read-only — the newest-created items are locked first, and all of them remain visible and counted in your totals and history; (b) shared-space members lose access to the owner's shared space and return to their own personal space; the owner keeps all data, including members' contributions; (c) if the owner resubscribes, members who lost access because of the lapse are restored automatically, and locked items unlock immediately. Members removed deliberately by the owner are not restored.
- Price changes. If we change the subscription price, Apple will notify you and, where required, ask for your consent before the next renewal.
7. Your content and data
7.1 Ownership
You own the content you create in the App — your transactions, shopping list items, budgets, goals, and other data you input. We don't claim ownership of your data.
7.2 License to us
To provide the service, you grant us a limited, non-exclusive, royalty-free license to host, store, transmit, display, and process your content only as necessary to deliver the App's functionality (e.g., showing your transactions to other members of your household). We do not use your content for any other purpose — not marketing, not AI training, not analytics.
7.3 Responsibility for your content
You are responsible for the accuracy and legality of the content you enter. We rely on you to enter correct numbers; we cannot verify your spending or financial situation independently.
8. Households ("spaces") and shared data
A "space" is a household in FamilySpend — a group of users who share financial data (transactions, lists, budgets).
8.1 Inviting others
When you invite a member to a space you own, you authorize them to view and contribute to that space's data. Once they accept, they have the access permitted by their role (owner or member).
8.2 What members see
All members of a space see all data within that space — that's the core value of FamilySpend. By joining a space, you accept this visibility.
8.3 Leaving or being removed
- You can leave a space anytime (Settings → Household).
- Space owners can remove members. Removed members lose access to the space's data immediately.
- Your past contributions to a space stay in that space after you leave — other members may need them for their context (e.g., a transaction you logged that contributed to the household's budget total).
- If you want your past contributions deleted from a space you've left, email privacy@hesti.app. We'll work with the remaining space members on this request, since deletion may affect their data continuity.
8.4 Ownership transfer
If you're the sole owner of a space and want to leave or delete your account, you must first either (a) transfer ownership to another member, or (b) delete the entire space (which requires all members' consent).
9. Acceptable use
You agree not to:
- Use the App in violation of any applicable law or regulation
- Reverse engineer, decompile, or attempt to extract source code (except to the extent permitted by law)
- Use automated tools (bots, scrapers, etc.) to access the App or our infrastructure without our written permission
- Attempt to gain unauthorized access to other users' accounts, other households, or our systems
- Interfere with or disrupt the App's operation (e.g., DoS attacks, spamming the API)
- Use the App to harass, threaten, or defraud other users
- Upload content that is illegal, infringing, defamatory, obscene, or otherwise objectionable
- Misrepresent your identity or affiliation
- Use the App for commercial purposes (e.g., running a business expense tracker for clients — FamilySpend is for personal household use)
Violations may result in account termination per Section 11.
10. Service availability
The App is provided as-is and we do not guarantee:
- Uninterrupted operation — outages may occur due to maintenance, third-party service issues (Supabase, Apple), or unforeseen events.
- Data accuracy — the App displays the data you and your household members enter. We don't verify it.
- Compatibility — newer iOS versions, device types, or system updates may affect compatibility; we'll do our best to support current iOS versions.
- Permanence — we may modify, suspend, or discontinue the App at any time. We'll give reasonable notice (typically 30 days) for discontinuation.
If the App becomes unavailable, we'll do our reasonable best to provide a data export path so you don't lose your information.
11. Termination
11.1 By you
You can stop using the App and delete your account at any time. Email privacy@hesti.app — deletion proceeds per the Privacy Policy.
11.2 By us
We can suspend or terminate your account if:
- You materially violate these Terms
- Your account shows signs of fraud, abuse, or unauthorized access
- Required by law or court order
- The App is discontinued (with reasonable notice)
For non-emergency terminations, we'll notify you and, where possible, give you a chance to fix the issue first.
11.3 Effect of termination
On termination, your account access ends. Data deletion proceeds per the Privacy Policy. Sections 7.1, 7.2, 12, 13, 14, 15, and 16 survive termination.
12. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
We are not a financial advisor, accountant, or tax professional. The App is a tool for tracking and visualizing your data. You are solely responsible for your financial decisions. Do not rely on the App as the sole source of truth for legally or financially significant matters (e.g., taxes, investments, debt management). Always consult a qualified professional for those.
Some jurisdictions don't allow disclaiming certain warranties; in those, the disclaimers apply to the maximum extent permitted by law.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, even if we've been advised of the possibility.
- Our total cumulative liability to you for all claims relating to the App is limited to the amount you have paid us in the 12 months immediately preceding the event giving rise to the claim. For users on the free tier, that amount is CAD $0 in the ordinary course. For users with active paid subscriptions, that amount equals the subscription fees you have actually paid us in the preceding 12 months.
- These limitations apply regardless of the legal theory (contract, tort, statute, or otherwise).
- This limitation does NOT apply to liability that cannot be limited or excluded under applicable Alberta or Canadian law, including but not limited to: gross negligence, willful misconduct, fraud or fraudulent misrepresentation, and death or personal injury caused by our negligence. In those cases, our liability is determined by applicable law without contractual cap.
Some jurisdictions (e.g., parts of the EU and UK) impose additional non-excludable consumer rights. Where those apply, our liability to consumers in those jurisdictions is governed by local consumer protection law.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Viacheslav Volosheniuk from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your misuse of the App
- Your violation of these Terms
- Your violation of applicable law
- Your infringement of any third party's rights through your use of the App
15. Governing law and dispute resolution
15.1 Governing law
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15.2 Informal dispute resolution
If you have a dispute with us, please email legal@hesti.app first. We'll respond within 30 days and try to resolve it informally. Most issues can be solved this way without litigation.
15.3 Court jurisdiction
If informal resolution fails, disputes shall be brought exclusively in the courts of the Province of Alberta, Canada (specifically, courts located in Calgary or Edmonton). You consent to the personal jurisdiction of those courts.
EU/UK consumer-protection laws may grant you the right to bring proceedings in your local courts; these Terms don't override those rights.
15.4 No class actions
To the extent permitted by law, you agree that disputes will be resolved on an individual basis, not as a class, consolidated, or representative action. (Some jurisdictions don't allow class action waivers; in those, this clause doesn't apply.)
16. Changes to these Terms
We may update these Terms. Material changes will be announced via:
- An in-app notification on your next login
- An email to your account email
- A revised "Last updated" date at the top
For non-material changes (typo fixes, clarifications), we'll just update the date. Material changes take effect 30 days after notification. If you don't agree, delete your account before the effective date.
17. Apple-specific terms
This App is distributed via the Apple App Store. The following terms apply to App Store distribution:
- Acknowledgment: These Terms are between you and us, not between you and Apple. Apple is not responsible for the App or its content.
- Scope of license: The license granted in Section 6 is limited to the App used on Apple-branded devices that you own or control, per Apple's Usage Rules.
- Maintenance and support: We (not Apple) provide maintenance and support.
- Warranties: If the App fails to conform to applicable warranties, you may notify Apple for a refund of the App's purchase price. The App itself is free to install; refunds for in-app subscription purchases are governed by Apple's standard refund policy. Apple has no other warranty obligation beyond these refund mechanisms.
- Product claims: We (not Apple) handle any claims relating to the App or your use of it.
- Intellectual property: In the event of a third-party IP claim, we (not Apple) handle the investigation and defense.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. General provisions
- Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us.
- Severability: If any provision is unenforceable, the rest stays in effect.
- No waiver: Our failure to enforce a right doesn't waive it.
- Assignment: You can't transfer these Terms without our consent. We may transfer them to a successor entity (e.g., if we incorporate or sell the App), with notice.
- Notices: Notices to you may be sent via in-app notification or to your account email. Notices to us go to legal@hesti.app.
- Force majeure: Neither party is liable for failure to perform due to events outside reasonable control (natural disasters, government actions, internet outages, etc.).
